Acquisition, development and construction (ADC) loans are on the agenda of regulators because of the growing risk of default. The FDIC is becoming increasingly more vocal about ADC risks as they focus on the costs to the insurance fund. At the heart of the FDIC’s concerns are examiner observations of underwriting weaknesses in ADC loan portfolios-- lenders added extra interest reserves when the underlying real estate project was not performing as expected. According to the FDIC, this practice can mask loans that would otherwise be reported as delinquent and erode collateral protection, increasing a lender’s exposure to credit losses. To make matters worse, FDIC examiners have observed instances where ADC loans with interest reserves made up a substantial proportion, or even a multiple, of bank capital.

Mr. Deutsch served as a consultant to financial institutions in strategic planning, profit improvement, financial management, and merger- and acquisition-related studies while working at KPMG. He was the CFO at a start-up bank, where he organized the accounting, finance, and investment functions to manage significant growth.
